…On this day in 1916 railroad employees won the right to Workers' compensation by Federal Employers Liability Act (39 Stat. 742; 5 U.S.C. 751). This showed the impact of the burgeoning age of progressivism in the US and the beginning of the fall of the Constitution. The name of this law was wholly false as the law only applied to RR workers. A similar law had been passed in 1906 but the Supremes struck it down because it was not limited to workers involved in interstate commerce. Congress got some new court members and went back to the trough. We have workers comp for everybody now.…
