The eight Supreme Court justices appeared evenly split during Monday's oral arguments in the case over President Obama's 2014 policy to not deport an estimated four million immigrants illegally living in the U.S.

That is likely a bad sign for the administration because a 4-4 split in U.S. v. Texas would mean that lower court rulings halting the policy would stand.…

The number of arrests made at the border of people from Afghanistan and Pakistan is up significantly this year compared to last, the president of the National Border Patrol Council said when he testified during a House hearing on Tuesday.

Brandon Judd, who has also served as a Border Patrol agent for nearly 20 years, also told the House Oversight and Government Reform Committee’s Subcommittee on National Security that he has witnessed U.S. Customs and Border Protection (CBP) officials fudge alien apprehension statistics by low-balling the number of “got aways…” Judd began by denying what he says is the Obama administration’s claim that “the border is more secure today than it’s ever been.”

WASHINGTON — U.S. Sen. James Lankford accused Democrats of hypocrisy Wednesday for insisting that the Supreme Court vacancy be filled during a presidential election year.

Lankford, R-Oklahoma, also vowed that Republicans would ensure President Barack Obama can’t appoint someone to the high court during a Senate break.

In a speech on the Senate floor, Lankford said, “We will also not allow a recess appointment.

“That has been floated multiple times in the media — that the president will just do a recess appointment and go around us. The Senate chooses when the Senate is in recess. Not the president. So we can do this. We can remain in continuous session without recess to prevent a recess appointment by this president through the rest of this year.…”
